Terms and Conditions
This Ufinity Network agreement explains your rights and responsibilities regarding the use of Ufinity Gift Cards. Ufinity Network reserves the right to terminate or alter any and all terms of this program at any time without any prior notice. By using an Ufinity Gift Card, you agree to be legally bound by the terms and conditions of this agreement.
Ufinity Gift Cards are issued by Ufinity Marketing Group, LLC as a way to help raise much needed funds for local schools and non-profit organizations while promoting local businesses within the community. The merchants that are part of Ufinity Network have agreed to offer their products and services at a substantial discount whenever an Ufinity Gift Card is redeemed. Due to this discount, Ufinity Network merchants have the right to exclude certain low profit items, high volume days, etc. from being eligible for purchase with the Ufinity Network Gift Card. All businesses will have their terms clearly stated on their Ufinity Network webpage.
Cardholder agrees to indemnify and hold Ufinity Network harmless from any and against any and all liabilities, losses, damages disputes, claims, counterclaims made between a cardholder and a member business. Cardholder agree to indemnify Ufinity Network and hold it harmless from any and all liability, including judgments, civil penalties, attorney fees, court costs as a result of cardholders' unauthorized representations. Cardholder acknowledges that Ufinity Network makes no warranty to Cardholder, whether expressed, implied, or statutory, as to the quality, merchantability, of the products or services purchased with the Ufinity Gift Card at member businesses. Cardholder agrees to hold Ufinity Network harmless in regards to the inability to use the Ufinity Gift Card, whether caused by external forces, such as power failure or server or other problems whether in our control or not. Ufinity Network disclaims all alleged liability for bodily injury or property damage resulting from any accident, event or occurrence on a member merchant location or use of the products or services from participating member merchants.
Use of an Ufinity Network Gift Card for alcoholic beverages of any kind is at the sole discretion of the merchant. The merchant agrees to be bound and follow all state laws with regards to the acceptance of gift certificates and alcoholic beverage sales. Use of the Ufinity Gift Card with any other certificates, gift cards, coupons, or promotions are at the sole discretion of the individual merchant and may not be allowed. Ufinity Gift Cards cannot be used for tips or any past balances due merchant. Ufinity Gift Cards have no cash value and no cash back will be given at redemption, or any other time, by the merchant or Ufinity Network. The issuing of credit by merchant on purchases made with the Ufinity Gift Card is at the sole discretion of the merchant unless otherwise required by law. Neither Ufinity Network, the seller of the card, or the merchant is responsible for lost or stolen gift cards. Any reproductions of Ufinity Gift Cards are not valid and will not be accepted by the merchant or Ufinity Network. Ufinity Network Gift Cards expire one year after their purchase and will be accepted up to that time by member merchants under the terms and conditions stated herein.
Your Ufinity Gift Card is a single use card and may be used at any participating Ufinity Member Merchant within our network. Participating Ufinity member merchants are under contract to accept your Ufinity Gift Card each and every time you come in. Ufinity Network does not represent, warrant or guarantee that any particular member merchant will accept the Ufinity Gift Card as payment for products or services. Please report any merchants that do not accept your card to Ufinity Network immediately to 877.803.7457. Merchants cannot exclude certain days or times unless such exclusion is listed on their terms and conditions section of their web page. Individual member businesses reserve the right not to accept the Ufinity Gift Card for certain products, services, specials, alcoholic beverages or entrée's. The member business is not required to tell you what is or isn't excluded unless you tell them, in advance, that you are using an Ufinity Gift Card, in which case they must, in good faith, disclose any items that you order or wish to purchase that are excluded. Neither Ufinity Network, nor the individual business, assumes any liability in the event a business, or business's employee, fails to disclose that the card is not valid for the items purchased.
All Ufinity Gift Cards must be used in their entirety. All Ufinity Network merchants have minimum and maximum purchase amounts that cardholder must adhere to. No change will be given. All Ufinity Network Gift Cards are single use cards and must be surrendered upon use to the merchant. Cardholder will not be given cash for your balance. Your gratuity, if any, should be based upon the full value of your purchase.
Disclaimers
You understand that Ufinity Network does not operate or control the products or services offered by our member restaurants, businesses or affiliate merchants. Participating restaurants, businesses and merchants are responsible for all aspects of the products or services in which they sell. Ufinity Network is not a party to the transactions entered into between you and the participating member merchants. Although the information provided to you on this site is believed to be true and reliable, Ufinity Network does not warrant that the program, information or services provided by Ufinity Network will meet your expectation or fit any particular purpose. You agree that participation in the Ufinity Network program is at your sole risk and that the program is provided to you without warranties of any kind, expressed, implied or otherwise.
Intellectual Property
The trademarks, logos and services marks displayed on the Ufinity Network site are the property of Ufinity Marketing Group, LLC and other parties. You are prohibited from using any such trademarks, logos, or service marks for any purpose without the written permission of Ufinity Network or such third party which owns the rights to the trademark, logo or service mark. All information and content on the Ufinity Network Site is protected by copyright. You are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any Content available on the Ufinity Network Site for any commercial purposes.
